These Terms of Service (“Terms”) govern your use of SpendMoth, including our website at spendmoth.com and our mobile applications (collectively, the “Service”). The Service is provided by MagiQa (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.
Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You are responsible for keeping your login credentials secure.
Your account and data
- You provide accurate registration information and keep it up to date.
- You enter financial information voluntarily; we do not pull data from banks automatically in the current release.
- You are responsible for the accuracy of amounts, categories, and card details you record.
- Do not share your account or use the Service for unlawful purposes.
Not financial advice
SpendMoth is a personal finance tracking tool. We do not provide tax, legal, investment, or credit counseling. Reports and insights are informational only. Consult qualified professionals for financial decisions.
Acceptable use
You agree not to:
- Attempt to access another user’s account or our systems without authorization.
- Upload malware, scrape the Service at scale, or interfere with normal operation.
- Use the Service in violation of applicable law or third-party rights.
Availability and changes
We may modify, suspend, or discontinue features with reasonable notice when practical. We strive for high availability but do not guarantee uninterrupted access. Maintenance, outages, or third-party failures may occur.
Intellectual property
The Service, branding, and software are owned by MagiQa or its licensors. You receive a limited, non-exclusive license to use the Service for personal, non-commercial purposes while these Terms remain in effect.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MagiQa AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or pose security risk. Upon termination, your right to use the Service ends; provisions that should survive (liability limits, dispute terms) remain in effect.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory local consumer protections apply.
